These terms govern how you use Propdart — what you can do on the platform, what you cannot, and the obligations each of us owes the other. They apply to everyone: buyers and renters, owners, agents, developers, banks and payment partners.

Introduction
This website www.propdart.com, including any subdomains, the related mobile and tablet applications, and the application programming interfaces through which our services are made available (collectively, "Propdart" or the "Platform"), is owned, hosted and operated by Propdart, a company organised under the laws of India with its studio at Himalaya Pride, Techzone 4, Greater Noida — 201310, Uttar Pradesh, India. These terms of use, together with our Privacy Policy and Community Guidelines, form a legally binding agreement between Propdart and the User (the "Agreement").
The Platform is an online information and communication service provided to you subject to your compliance with the terms set out below. Propdart may amend these terms at any time and such modifications take effect immediately upon being posted on the Platform. Your continued use of Propdart after a change is published constitutes your acceptance of the amended terms. We may also suspend the Platform from time to time for support, maintenance, content updates or for any other reason.
If you use Propdart in a manner inconsistent with these terms, we may terminate your access, block future access, and pursue such additional remedies as may be available to us at law.
Eligibility & your account
To use the Platform you must be at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872. If you use the Platform on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these terms, in which case "you" refers to that entity. The Platform is not directed at children, and we do not knowingly permit persons under 18 to register or transact.
Registration. When you create an account you agree to provide true, current and complete information and to keep it updated. Providing false, misleading or incomplete information, or impersonating any person or entity, is a breach of these terms.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorised by you. You must notify us immediately at support@propdart.com of any unauthorised use or suspected breach of security. Propdart is not liable for any loss arising from your failure to safeguard your credentials. We may suspend, restrict or terminate your account where we reasonably suspect misuse, a security risk, or a breach of these terms.
Definitions
- Subscriber / User — any individual or legal entity that has subscribed to the Services (whether on a paid or free basis) and to whom access is restricted by use of a sign-in username and password.
- Browser / Visitor — a person who uses the non-restricted portions of the Platform without creating an account.
- Advertiser — a Subscriber or User uploading or relaying content using the Services (typically agents, owners, developers and consultants).
- User / Customer — collectively, Subscribers, Advertisers, Browsers and Visitors.
- Services — the interactive online information service offered by Propdart, including search tools, listings, banners, advertisement space and any related functionality. Propdart acts solely as a medium for information exchange and not as an agent of any User.
- RERDA — the Real Estate (Regulation and Development) Act, 2016, together with the rules and regulations framed thereunder.
Any person who accesses the Platform without a legal or contractual right to do so is an "unauthorised user" and remains bound by these terms, in particular those relating to intellectual property.
Submission and administration of listings
You agree not to submit any property description, photograph, financial detail, contact information or other listing data to Propdart unless you have obtained all necessary rights and authorisations from the owner of that property (or the power-of-attorney holder), including from the photographer or copyright owner of any photographs, to publish and advertise the property on Propdart.
Propdart does not claim ownership of, and has not independently verified, any banner, listing or image hosted on the Platform by Users. Some listings may contain third-party audio or video content ("AV Content") supplied for general information only — no recommendation, solicitation or guarantee of accuracy is made by Propdart or by the AV Content provider. You consent to the use of any content or information you provide for promotional, marketing and publicity purposes without additional compensation.
If you are covered by RERDA, you must obtain all approvals, licences and permits required for the project, land, apartment or plot listed, and remain in compliance with all applicable laws and disclosure obligations at all times. You must disclose all material information including correct dimensions, registration particulars, present status, encumbrances, title and ownership. Propdart may require additional evidence — including documents or a sworn affidavit — to substantiate the claims made in any listing.
By submitting a listing you agree:
- (a) to represent and warrant that all properties and associated information you provide are accurate;
- (b) not to permit any property to be posted under a name other than that of a real estate professional duly authorised by the owner.
Propdart may, at its sole discretion, remove listings alleged to be in violation of this clause, request additional evidence, or terminate accounts of Users who repeatedly or intentionally violate these terms. You authorise Propdart to display, index, search, surface and modify listings on the Platform as part of providing the Services.
Buyers and renters dealing through Propdart must independently verify a property's right, title, ownership and lien before transacting. A "verified" tag on a listing only indicates verification of the existence of the property as advertised; it does not certify documentation, ownership, area or pricing.
Content & moderation
We use a combination of proprietary and third-party tools — including automated and AI-assisted systems — to identify and address content that violates these terms or applicable law, including harmful behaviour and unlawful speech. Moderation may operate automatically or with human oversight depending on complexity. Based on the output, content may be approved, rejected, or escalated to a human reviewer.
Users have the right to raise grievances or appeal moderation decisions under our Grievance process. While we work to maintain accuracy and fairness, no system is perfect; these measures are provided on an "as is" basis and are continuously refined.
User content, feedback & licence
"User Content" means any listing, photograph, text, review, rating, message or other material you submit, post or display on or through the Platform. You retain ownership of your User Content, but by submitting it you grant Propdart a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to host, store, use, reproduce, adapt, publish, translate, distribute and display that User Content for the purpose of operating, providing, promoting and improving the Services. This licence continues for as long as the content remains on the Platform and for a reasonable period thereafter to the extent required for backups, legal compliance and dispute resolution.
Your warranties. You represent and warrant that you own or have all necessary rights, consents and permissions to submit your User Content and to grant the licence above, and that your User Content does not infringe the rights of any third party or violate any applicable law. You are solely responsible for your User Content and for the consequences of submitting it.
Feedback. If you provide suggestions, ideas or feedback about the Platform, you grant Propdart an unrestricted, perpetual, irrevocable and royalty-free right to use and incorporate that feedback without any obligation or compensation to you.
Removal. Propdart may, but is not obliged to, review, screen, refuse, edit or remove any User Content at its discretion, including content we believe violates these terms or applicable law, without prior notice and without liability.
Payment terms
- Payments for the Services are on a 100% advance basis. Once subscribed, fees are non-refundable and any amount paid stands appropriated. Refunds, if any, are at the sole discretion of Propdart. Propdart gives no guarantee on the timeliness of refunds reaching your card or bank account.
- Propdart may set off any amount paid or payable by a Subscriber against any other amount payable by that Subscriber to Propdart under any other agreement or commercial relationship.
- Propdart gives no guarantee of server uptime or that any application will function without interruption. All Services are provided on a best-effort basis and our liability is limited to refund of the amount paid. No liability is assumed for free Services.
- For online transactions you will be directed to a third-party payment gateway. Propdart does not store credit-card data; once the gateway transaction is complete, the payment information is not accessible to Propdart.
- If you choose an EMI option with your financial-service provider, Propdart is not a party to that arrangement and receives the full payment upfront.
- Where the bill-to, ship-to and paying customer are different entities, each entity represents that it has a valid internal arrangement authorising its engagement with Propdart and agrees to indemnify Propdart from any claim arising out of such inter-se arrangement. KYC documents must be provided on request. The contract is deemed accepted within one working day of (a) the invoice date for the bill-to customer, (b) the payment date for the paying customer, and (c) subscription activation for the ship-to customer, unless a written objection is received within that period.
- Cash payments towards subscription fees are strictly prohibited. No Subscriber shall tender cash to any person claiming to act on behalf of Propdart. Any such payment is invalid and shall not discharge the Subscriber's liability.
- Propdart shall not be liable for any loss or damage arising from any inadvertent or otherwise disclosure of information concerning a User's account or any error, omission or inaccuracy in such information.
Refunds in failed transactions
Although our payment reconciliation team operates 24×7, Propdart offers no guarantee on the timeliness or accuracy of refunds reaching your card or bank, given the multiplicity of organisations involved in online payments and the working calendars of financial institutions. Refunds in the event of incorrect or objectionable listing content are at the discretion of Propdart.
Activation of subscriptions
Propdart shall not sell or provision any subscription that the Customer intends to activate or use more than (i) thirty (30) days after the approval date of the relevant Service Order for agents and brokers, or (ii) sixty (60) days after the approval date for developers. Subscriptions must commence within these windows.
For the purposes of this clause, "Customer" means any broker, developer or other contracting party that places a Service Order or procures Services from Propdart, including its permitted representatives, successors and assigns.
- No request for deferment beyond this period will be entertained; payments stand appropriated.
- Unutilised products or services within the subscription validity period cannot be extended.
- Any exception to delayed activation is at the sole discretion of Propdart.
Use of information
You agree to treat all information obtained from the Services — including listings, member directory and any other Service content ("Content") — as proprietary to Propdart. Content reserved for members must be kept confidential and shall be protected as a trade secret of Propdart. Propdart does not warrant the accuracy of, endorse or recommend any Content; you use it at your own risk.
You may access listings only to obtain initial information from which further evaluation may commence. You shall limit access to and use of listings to personal and internal use, and shall not use listings obtained from the Services for further distribution, publication, public display or preparation of derivative works.
You shall not use any Content in connection with any other listing or advertising service or device. Users searching the Services in an abusive or excessive manner, whether by automated or manual means, may have their access terminated without notice.
Intellectual property
All logos, brands, trademarks and service marks ("Marks") appearing on Propdart are owned by, or used under licence by, Propdart and its affiliates. Access to the Platform does not grant you any licence or right to use these Marks. Any unauthorised use is strictly prohibited and may constitute an offence under applicable law.
Propdart respects the intellectual-property rights of others and expects Users to do the same. If you use the Platform to infringe the intellectual-property rights of any person, we may terminate this Agreement immediately and without notice.
Subject to your continued compliance with these terms, Propdart grants you a limited, non-exclusive, non-assignable, revocable licence to access and use the Services.
Restrictions & prohibitions
The following actions, among others, constitute a misuse of Propdart and are strictly prohibited:
- Using the Services in any manner that impairs Propdart's functioning or that is non-compliant with applicable laws including RERDA.
- Copying, extracting, downloading, sharing, modifying, selling, storing, distributing or creating derivative works from any content, data, profile, personal detail, photograph or graphic available on Propdart.
- Using the Platform or any Content for commercial purposes such as building alternate databases, extending access to third parties, undertaking business in competition with Propdart, sharing access with non-contracted parties, or reselling Propdart's products and services.
- Using any automated program, software or system (including spiders, robots, crawlers, scrapers, browser extensions, iframes, mirrors or HTML parsers) to access, navigate, copy, monitor, download or extract any data or content from the Platform.
- Gaining or attempting to gain unauthorised access (by hacking, password mining or otherwise) to any portion of the Platform, our servers, our systems, or those of any third party or User.
- Modifying the Services or their appearance, simulating Propdart's services or functions, or overlaying any additional offering on top of the Services without our prior written consent at product@propdart.com.
- Accessing the Platform through interfaces other than those expressly provided by Propdart.
- Attempting to breach or test the security or authentication measures employed by Propdart or by any third party in relation to the Platform.
- Scraping or bulk-downloading data to offer products or services similar to, or competing with, those of Propdart.
- Reverse-engineering, decompiling, disassembling, deciphering or otherwise deriving the source code of the Platform or any related technology.
- Circumventing technological protections used by Propdart or by any third party to protect Platform content or to exclude robots from crawling or scraping.
- Bypassing or attempting to circumvent any service limits including search limits, captcha limits and trigger occurrences.
- Interfering with or disrupting the use of the Platform or any computer network connected to it by any other User.
- Impersonating any other person or entity or misrepresenting your employment by, or affiliation with, any person or entity.
- Forging headers or otherwise manipulating identifiers to disguise the origin of any user information.
- Stalking, threatening or harassing any other User.
- Imposing an unreasonable or disproportionately large load on our infrastructure.
- Framing, mirroring or otherwise simulating the appearance or function of the Platform, or deep-linking into it, without our prior permission.
- Spamming Propdart or any other User including by sending unsolicited bulk or commercial email, SMS or messages.
- Hosting, modifying, uploading, posting, transmitting, publishing or distributing any material that:
- violates any applicable law, statute, regulation or rule;
- belongs to another person and to which you have no right;
- infringes any copyright, trademark, patent, right of privacy or publicity, or other proprietary right of Propdart or any third party;
- contains viruses or other code designed to disrupt, destroy or limit the functioning of any computer system;
- is harmful, harassing, invasive of another's privacy, hateful, disparaging, relating to money laundering or gambling, threatening, abusive, libelous, blasphemous, vulgar, pornographic, paedophilic, obscene, or that promotes enmity between groups on the grounds of religion or caste;
- encourages conduct that would constitute a criminal offence or otherwise violate applicable law;
- deceives or misleads the addressee about its origin or communicates misinformation;
- harms minors in any way;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, public order, or causes incitement to any cognisable offence.
You also agree not to (i) copy or distribute Platform information on any other server or modify, re-use or re-publish it on any other platform; and (ii) remove any copyright, trademark or other proprietary notice from any material copied or printed from the Platform, or link to the Platform, without our prior written consent. Violations of system or network security may result in civil or criminal liability.
Third-party links
Propdart may provide links to other third-party websites or resources. We make no representations whatsoever about any third-party site you may access through the Platform.
Disclaimer & warranties
Propdart is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.
THE CONTENT OF PROPDART IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Propdart and any third party providing materials, services or content through the Platform disclaim all warranties, express or implied, statutory or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement of third-party rights, completeness or accuracy of information, currency or correctness of information, freedom from viruses, and other violations of rights regarding the Services, products, materials and contents of the Platform.
Views expressed by Users are their own; Propdart does not endorse them and shall not be responsible for them. No claim is made as to the accuracy of information on the Platform although every reasonable attempt is made to ensure the content is not misleading, offensive or inappropriate. Report any concern via our grievance channel.
You alone are responsible for evaluating the accuracy, completeness and usefulness of any opinion, advice, service, real-estate or related information listed on the Platform. Propdart does not warrant that access to the Platform will be uninterrupted or error-free, or that defects will be corrected. Propdart gives no guarantee that a listing or banner will receive any response; payments made are solely for the display of the property advertised.
Users are strongly advised to independently verify the authenticity of any pre-launch offers. Propdart does not endorse investment in projects which have not received official sanction and have not been launched by the builder or promoter; Users dealing in such projects do so entirely at their own risk.
The Platform is controlled and operated from India. We make no representation that the materials are appropriate or available for use in other parts of the world. If you access Propdart from outside India, you are responsible for compliance with applicable local laws, conventions and treaties.
Limitation of liability
Propdart will not be liable for any damages of any kind arising out of or relating to the use of, or inability to use, the Platform, its content or its links — including damages caused by errors, omissions, interruptions, defects, delays, viruses, line failure, and any direct, indirect, special, incidental, punitive, exemplary or consequential damages or loss of profit, whether based on warranty, contract, tort or any other legal theory (including force majeure), and whether or not Propdart was advised of the possibility of such damages.
Propdart assumes no responsibility for any error, omission, interruption, deletion, defect, delay, communication-line failure, theft, destruction, or unauthorised access to or alteration of a User's data. Propdart shall not be responsible for any technical malfunction in on-line systems, servers, software, computer equipment, email or players, on account of technical problems or traffic congestion on the Internet.
For the purposes of the Consumer Protection Act, 2019, the term "Consumer" is limited to paid Customers who have not subscribed to Propdart for purposes of commercial gain. Unless otherwise specified, Propdart's performance obligation is to provide access to the Platform for the duration of the subscription period; any reference to usage describes an upper limit for consumption and does not by itself create an additional performance obligation.
Force majeure
Propdart shall not be liable for any failure or delay in performing its obligations, or for any loss or damage, arising from any event or circumstance beyond its reasonable control. Such events include, without limitation, acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, riot, civil unrest, governmental action, order or restriction, change in law, strikes or labour disputes, failure of power, telecommunications or internet services, cyber-attacks, and failures of third-party hosting, network or payment providers.
During the continuance of such an event, Propdart's affected obligations shall be suspended and the time for performance extended accordingly. This clause does not relieve you of any obligation to pay amounts that are already due.
Termination
Propdart may, without notice and at its sole discretion, terminate or restrict your use of or access to the Platform (or any part of it) for any reason — including, but not limited to, where Propdart believes you have violated or acted inconsistently with the letter or spirit of these terms or any applicable law.
Propdart further reserves the right to cancel transactions or take any other appropriate action where it determines that any transaction, activity or conduct lacks transparency or raises concerns regarding authenticity, fairness, compliance or legality — including suspected misrepresentation, fraudulent intent, misuse of systems or payment mechanisms, violation of applicable laws, misbehaviour with Propdart employees, or any act that may expose Propdart to financial, legal, reputational or operational risk.
Indemnification
Submissions and unauthorised use of any information or material on the Platform may violate copyright, trademark, privacy, publicity or other applicable laws. You alone are responsible for your actions and for the actions of any person using your username or password.
You agree to defend, indemnify and hold harmless Propdart and its associates, subsidiaries, officers, directors, employees, affiliates, licensees, business partners and agents from and against any claim, action or demand — including reasonable legal and accounting fees — arising from your use of the Platform or your breach of these terms or any applicable law.
Propdart will not be a party to legal proceedings between Users contracted through the Services. Where Propdart is named in such proceedings, costs will be recovered from the party that named Propdart. Propdart will abide by any court order served on it through due process.
Terms specific to Users
- When you indicate interest in a real-estate listing or in a related service, you authorise Propdart to contact you (even if you are registered with NDNC / DNC) and you authorise Propdart to share your profile and information with the relevant advertiser, seller or service provider, who may further contact you by phone, email or WhatsApp.
- Propdart is not responsible for the content of an advertiser's or seller's application form, messages, screener questions, assessments or required documents, or for their format or method of delivery.
- You consent to your application and responses being processed and analysed by Propdart under these terms and our Privacy Policy. Propdart may use this material — including your public profile and responses — to determine whether you may be interested in a listing, and may reach out to you by calls, SMS or email about similar listings (even if you are registered on the National Customer Preference Register).
- Information you post in public areas of the Platform may be accessed, used and stored by others around the world, including in jurisdictions that may not provide the same level of data protection as your country of residence. You should not post sensitive information you would not want made public.
- It is your responsibility to use the privacy and opt-out settings provided on the Platform to control access to your data by other Users such as dealers.
- If you sign in using a third-party identity provider (such as Google), you authorise Propdart to access and use the account information described in our Privacy Policy.
Terms specific to dealers, builders, banks & gateways
- You will comply with all applicable data-protection laws when processing personal data and will not process personal data which is irrelevant, unlawful or excessive with regard to the purposes agreed under these terms and our Privacy Policy.
- You shall implement adequate technical and organisational controls to protect personal data obtained from Propdart against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure.
- You agree to provide reasonable assistance to facilitate the handling of any data security breach in an expeditious and compliant manner.
- The responsibility for complying with an individual's request in respect of his or her personal data lies with the party that holds or processes that data.
- You shall not transfer personal data obtained from Propdart to any sub-processor without ensuring equivalent safeguards.
- You shall retain or process shared personal data only for as long as is necessary to carry out the agreed purposes.
Arbitration, governing law & jurisdiction
Any dispute between a User and Propdart arising out of, or in connection with, the validity, interpretation, implementation or alleged breach of these terms shall be referred to a sole arbitrator who shall be an independent and neutral third party. The decision of the arbitrator shall be final and binding. The seat of arbitration shall be Greater Noida, Uttar Pradesh, and the proceedings shall be governed by the Arbitration & Conciliation Act, 1996.
These terms are governed by the laws of India. The courts at Gautam Budh Nagar, Uttar Pradesh shall have exclusive jurisdiction in all matters relating to the Platform and these terms, irrespective of the territory from which you access Propdart.
If any provision of these terms is held to be invalid by a court or under any applicable law, the remaining provisions shall continue in full force. The failure of Propdart to exercise any right or provision shall not constitute a waiver of that right or provision.
General provisions
Entire agreement. These terms, together with our Privacy Policy and any other policies or notices referenced here, constitute the entire agreement between you and Propdart regarding the Platform and supersede all prior or contemporaneous understandings on the subject.
Assignment. You may not assign or transfer your rights or obligations under these terms without our prior written consent. Propdart may assign or transfer these terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganisation or sale of assets.
Severability & waiver. If any provision of these terms is held to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will continue in full force. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
Survival. Provisions that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution — shall survive any termination or expiry of these terms.
Electronic communications & notices. You consent to receive communications from us electronically — including by email, SMS, in-app message or by notices posted on the Platform — and you agree that all such communications satisfy any legal requirement that they be in writing. Notices to Propdart must be sent to legal@propdart.com.
Relationship of the parties. Nothing in these terms creates any partnership, joint venture, agency, franchise or employment relationship between you and Propdart. Propdart acts only as an intermediary and is not a party to any transaction between Users.
Headings. Section headings are for convenience only and do not affect the interpretation of these terms.
Grievances & contact
Propdart does not routinely monitor User postings but reserves the right to do so. If we become aware of inappropriate use, we may take any action we consider appropriate, including reporting to law-enforcement authorities and cooperating fully with any investigation.

Please report any violation of these terms to legal@propdart.com. Propdart reserves all other rights.
We aim to acknowledge every complaint within 48 hours of receipt and to redress it within the timelines prescribed under applicable law. If you are not satisfied with our response, you may escalate the matter to the appropriate regulatory, adjudicatory or judicial authority, including the Data Protection Board of India in respect of personal data.
